After reading the artical, when do women use condoms? AND is removing a chasity devisewithout permission considered Unconsented Removal or Tampering With a Sexually Protective Device? Just who's permission is needed to remove said device?

This has been proposed in a couple of other states as well as Ca in the past. California's proposed law doesn't make it a criminal act - but the victim can pursue civil actions. Consent is difficult to prove - the burden of proof is simpler in a civil vs criminal court. Sex workers will be able to sue their clients for “stealthing”.

Female condoms have been around for at least 30 years. I don't think they are widely popular.

California is really the land of fruits and nuts. How about worrying about sky high taxes and homeless pooing in the streets, etc?

A man was just convicted of “stealthing” in the Netherlands. Apparently he texted the woman afterwards that he had removed his condom and assured her she was all right. Sex was consensual so it wasn’t rape. He got a fine and a suspended sentence.

Several countries prosecute it as criminal sexual assualt (Canada, Germany, Netherlands, New Zealand, Switzerland, UK ....), some as equivalent to rape. In the US it is not covered except in CA (2021) where it is still considered "sexual battery" - a civil crime - not a crimianl offense.

Well. Removing a condom without permission could lead to transmission of diseases and/or pregnancy. If the woman consented to intercourse with a condom and the condom was stealthily removed, why couldn't there be legal consequences?

Hard to prove,….. lack of comprehensive laws. Many countries do have laws, but getting someone to come forward, and proving it would almost require someone to admit they did it intentionally. Possible false claims? It’s a slippery slope! Not saying it’s right, just difficult. Current laws span a minor disdemeanor to outright rape.
